El ex vicepresidente se encuentra bajo prisión domiciliaria desde el último lunes, por la emergencia sanitaria a raíz del coronavirus.
El ex vicepresidente Amado Boudou aseguró hoy que seguirá «peleando por su inocencia» y pidió a la sociedad que “acompañe al Gobierno”; mientras el fiscal que interviene en el caso Ciccione, Marcelo Colombo, apeló el beneficio de la prisión domiciliaria que se le concedió esta semana al ex funcionario.
«Voy a seguir peleando por mi inocencia y la de los otros presos políticos porque hay un esquema de lawfare y persecución: es muy claro que están usando a la Justicia para anular los procesos populares en Sudamérica», dijo Boudou en diálogo con El Destape Radio.
El juez Daniel Obligado decidió que el ex vicepresidente continúe detenido en su domicilio desde la noche del lunes último, ante “el actual contexto mundial de emergencia sanitaria” por el coronavirus y la «falta de firmeza de la pretendida condena impuesta a Boudou», ya que esa sentencia no está firme debido a que fue apelada ante la Corte Suprema de Justicia.
El ex funcionario había sido condenado en 2018 a cinco años y medio de prisión por cohecho pasivo y negociaciones incompatibles con la función pública en el caso Ciccone.
«Hay que acompañar al Gobierno en mejorar la distribución del ingreso y el mercado interno; vienen momentos de apostar mucho más fuerte a la economía interna y la producción local”, consideró.
En tanto, esta tarde, el fiscal general Colombo apeló el fallo que otorgó al ex vicepresidente el beneficio de la prisión domiciliaria tras considerar que se trató de una decisión “arbitraria” y contradictoria con decisiones anteriores tomadas por el mismo tribunal.
“La resolución indicada resulta arbitraria porque contradice una decisión previa dictada por el mismo órgano y juez decisor, cinco días hábiles atrás, y sin la aparición de circunstancias sobrevinientes que pudieran motivar tamaño giro procesal”, sostuvo el fiscal al apelar el fallo firmado el lunes por el juez Obligado.
“También lo es porque en esta segunda oportunidad lo ha hecho sin correr nueva vista al Ministerio Público Fiscal, fulminando con tal actitud cualquier resto de legalidad que pudiera conservar este segundo e inaudito trámite de excarcelación o morigeración de la detención del imputado”, sostuvo Colombo.
Ahora el juez Obligado deberá decidir si hace lugar a la apelación del fiscal para que la Cámara Federal de Casación Penal revise el fallo; aunque en caso contrario el representante del Ministerio Público podrá apelar a un recurso directo que le permita llegar a ese tribunal.
